Expert Witness

An expert witness is defined as “someone who is permitted to testify at a trial because of special knowledge or proficiency in a particular field that is relevant to the case.”  We believe an expert needs to do more than just testify.  A good expert will educate counsel on all facets of the investigation.  The expert’s job is to provide an unbiased opinion of the events even when unfavorable to the side that he or she represents, allowing counsel to make the best decision for his/her client.

Niebuhr Metallurgical Engineering, LLC has been helping attorneys since 2003, when Dr. Niebuhr was retained by the district attorney to investigate and testify in his first case involving a triple vehicular homicide resulting from a horse ejected from its trailer.  A key element of this case was the condition of the horse trailer prior to the night of the collision and whether is was reasonable to haul 2000 lbs of livestock given the trailer’s age and state of disrepair.

Since then, Dr. Niebuhr has been retained on over 60 cases to serve as an expert witness. The types of cases include consumer product failure, patent disputes, personal injury, biomedical, heavy industry, and oil & gas to name a few.  Most of our cases have settled before trial.  When compromise was not achieved we have been called upon to testify in both federal and state court for both criminal and civil matters.
